These General Terms and Conditions of Sale govern the contractual relationship between the company Les Barquettes SASU and any natural or legal person wishing to charter a vessel or book any service.
Reservations can be made online via the websites www.lesbarquettes.fr and www.laflaneuse.fr, or by phone or email.
Les Barquettes reserves the right to modify the routes or cancel the services in case of bad weather conditions. Only the captain is authorized to judge the navigation conditions, and is liable to cancel a maritime service. Swimming during stops is permitted at your own risk. Under no circumstances can the loan of swimming equipment be considered equivalent to a supervised water sports activity. Passengers agree in all cases to comply with the regulations on board the ships, established by Les Barquettes, as well as to comply with the orders of the captain and his officers. Passengers must arrive at the dock 15 minutes prior to the scheduled boarding time. No refunds will be granted in the event of passenger lateness.
Passengers must inform Les Barquettes of any contraindication or unsuitability that would prevent the performance of the services offered (Nautical activities: maritime excursion, water sports and aquatic activities, swimming, snorkeling, etc.). Passengers board at their own risk and may not hold Les Barquettes liable for any personal injury related to their health condition (disability, illness, etc.), whether on board, during boarding or disembarking, or during nautical or water-based activities. Passengers requiring special assistance due to their health condition during the excursion or nautical activities (persons with reduced mobility, the visually impaired, etc.) are requested to inform Les Barquettes at the time of booking and the crew upon boarding.
Pregnant women can take a sea excursion, under their own full responsibility, subject to the presentation to Les Barquettes of a medical certificate of no contraindication to maritime navigation. However, they may not hold Les Barquettes liable for any reason in the event of personal injury.
Les Barquettes shall not be held liable for any personal injury or other incident related to the pregnancy.
Les Barquettes does not provide transport for unaccompanied minors. They will board and participate in excursions, as well as nautical and water-based activities, under the sole responsibility of their accompanying adult(s). Children aged 10 months to 10 years are required to wear a suitable life jacket. Parents must notify Les Barquettes of their presence at the time of booking or before boarding.
Passengers must remain seated while the vessel is underway. They must comply with the vessel’s regulations—specifically those established by Les Barquettes—during boarding and disembarking as well as while on board, and generally follow the recommendations or instructions of the captain or crew. Les Barquettes accepts no liability for any personal injury sustained by passengers who fail to comply with this requirement, whether on board or during boarding or disembarking. Passengers are liable for any damage of any kind caused to themselves, other passengers, third parties, or the personnel and property of Les Barquettes. The same applies to any damage of any kind caused by persons or property under the passengers’ care.
Les Barquettes permits swimming during excursions at designated “swimming stops” in the “calanques” (coves). However, swimming is unsupervised and takes place at the passengers’ own risk. Minors must remain under the supervision of their accompanying adult(s) during these times. Non-swimmers or weak swimmers must inform the crew. Les Barquettes provides passengers with floating life jackets. Les Barquettes declines all responsibility in case of incidents or personal injury occurring during swimming.
Any damage occurring during excursions or nautical and aquatic activities must be reported by the passenger to Les Barquettes before leaving the ship. Passengers must report any personal injury or damage to their property (personal belongings) to the ship’s crew. Les Barquettes will draw up a joint report with the passenger(s) concerned before disembarkation. Failure to comply with this requirement will result in a presumption that passengers disembarked safe and sound and that their property was in good condition. Les Barquettes declines all responsibility, except in the cases provided for by articles L5421-2 et seq. of the Transport Code, for bodily injury occurring during navigation, during excursions or nautical and aquatic activities, or during embarkation or disembarkation operations, either at ports of departure or destination, or at ports of call, or at sea during swimming.
Passengers may bring their own personal equipment—such as mobile phones, cameras, masks, snorkels, fins, etc.—at their own risk. Les Barquettes declines all responsibility concerning luggage, personal item(s) or equipment carried by passengers, as well as for money, jewelry or other valuables which remain during excursions and any other activity offered by Les Barquettes, under the exclusive responsibility of their owners.
Les Barquettes provides passengers with equipment—such as masks and snorkels—free of charge for use during the nautical and aquatic activities it offers. Any defect or inadequacy regarding the equipment does not entitle the passenger to a refund or price reduction of any kind. Les Barquettes reserves the right to take legal action against passengers who intentionally damage, deface, or steal the equipment provided on a complimentary basis.
During excursions organized by Les Barquettes, the moderate consumption of alcohol (wines, beers, ciders, and any alcohol with an ABV strictly below 20%) and tobacco is permitted. For reasons of passenger safety and comfort, Les Barquettes staff may limit or prohibit the consumption of alcohol or tobacco. The consumption of drugs or other narcotic substances is strictly prohibited. Les Barquettes may implement all necessary steps or constraints with regard to passengers who, due to their behavior: endanger a person or a member of staff, damage or deteriorate property belonging to Les Barquettes, prevent staff from fulfilling their duties, do not respect the recommendations and instructions of staff members or the captain. Les Barquettes reserves the right to disembark passengers whose behavior compromises the safety, peace, or comfort of other passengers or staff members; in such cases, the passenger is not entitled to any refund.
If sailing is not possible, the captain reserves the right to cancel the service. In such cases, the Charterer will be refunded the deposit paid.
If the Charterer wishes to cancel the booking, cancellation fees depend on the date of notification:
More than 30 days before the scheduled service date: full refund
Less than 30 days before the scheduled service date: no refund
Booking modification: Any modification to the booking is subject to approval by Les Barquettes. Approval of a modification request is not guaranteed. Booking modification fees may apply.
Les Barquettes makes every effort to provide photos and illustrations giving an overview of the selected services. Unless expressly agreed in writing by Les Barquettes, it is strictly forbidden to use for commercial, promotional and/or lucrative purposes the photos and videos taken during the excursion and representing all or part of the Ship. Unless explicitly stated otherwise, the passenger may not, under any circumstances, reproduce, represent, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever for commercial, promotional or lucrative purposes all or part of the photos and videos taken during the excursion and representing all or part of the ships operated by Les Barquettes.
It may happen that some activities offered by Les Barquettes and indicated in the description on the company’s website are cancelled, particularly due to weather conditions or force majeure.
Events such as weddings, parties, or other celebrations, as well as filming or photo shoots, must be declared at the time of booking. These may be subject to special pricing due to the specific nature of the event. Les Barquettes reserves the right to refuse certain activities on board.
Booking a service or chartering a vessel from the company implies the client’s unreserved acceptance of these General Terms and Conditions of Sale.
The liability of the maritime carrier is governed by the laws of June 18, 1966, January 3, 1967 and December 21, 1984. The carrier cannot be held liable in the event of a change in schedules or cancellation of departures due to force majeure, unforeseen circumstances or otherwise. Passengers must retain their tickets for presentation during any inspection. They agree to comply with on-board regulations and to follow the captain’s orders. No claims will be accepted once the vessel has departed. The shipowner reserves the right to cancel or modify services in the event of adverse weather conditions.
The General Terms and Conditions, and more generally the contract concluded between the passenger and Les Barquettes, are governed by French law. Any dispute relating to their formation, performance, termination, and/or interpretation falls within the jurisdiction of the French courts.
The Charterer must comply with the safety and navigation instructions provided by Les Barquettes. In the event of non-compliance, Les Barquettes reserves the right to terminate the service at any time without refund.
